MINNEOLA CITY COUNCIL MEETS                                    August 15, 2022

The Minneola City Council met in regular session August 15, 2022, in the Civic Connection. The meeting was called to order at 7:00 p.m., with the following council members present: Marvin Jensen, Dustin Laudick, and Chad Kirk. Mayor Carol Sibley presided.

Alan Luttrell, EBH, mentioned that both projects (Waterline & South well) are almost complete. There has been a small set-back that the meter head sent for the south well was the wrong one and a new one had to be ordered. Alan presented CO #6, in the amount of $16,917.38, for the waterline project, which includes adding dehumidifiers to all 3 well houses, replace the light in the chlorine room at the south well, and cost to raise the fire hydrant. Marvin made a motion to approve CO #6, Chad seconded, motion passed 3/0. APAC pay estimate #14 was presented. Dustin moved to approve the pay estimate, Marvin seconded, motion passed 3/0. Pay estimate #2, for the south well project, was presented. Marvin made a motion to approve pay estimate #2, Chad seconded, motion passed 3/0.

Marvin made a motion to go into executive session for 30 minutes with City Attorney Morgan Koon (on the phone) for Attorney-Client privileges and discussion of acquisition of real estate. Council, Mayor, City Manager, and City Clerk were asked to remain. Executive session started at 7:10 pm.  Council came out of executive session at 7:40 pm. Chad made a motion to purchase the property and easements, Dustin seconded, motion passed 3/0. Brenda to contact Ranson Financial to have them proceed with the bond and the Council requested a special session be held on August 29, at 6:00 pm, at the Civic Connection, to open bond bids and sign any necessary paperwork.

Thomas Miller met with the Council about a new business that he is opening. It is called Miller Machine and Fabrication and will be at 102 N. Main Street. He has both his FEIN and Kansas Retailer’s Sales Tax Certificate. The Council welcomed his new business.

Diana Beebe presented a letter from Minneola Senior Center Inc to the Council about the mini-bus. The Minneola Senior Center Inc. would like to take over the bus. The title and TR-12 form will be filled out and given to them this week. The City agreed to let them continue to store the bus in the City shop building.

Marvin made a motion to approve the minutes from July 18, 2022, Dustin seconded, motion passed 3/0.

Computer printouts showing the financial status for the month of July were reviewed. There were no questions.

The Council agreed to give a citizen, who was in the process of having a private well drilled prior to Ordinance 2022-03, 60 days to provide us a copy of a signed contract.

For the CCLIP grant, Tyler and EBH met with two of the business owners last week. Offers were made for the temporary and permanent easements as determined by the appraisals. There is one property owner yet that we need to meet with. If the offers are not accepted, the next step would be condemnation.

The pool closed for the season on August 13. We did not have enough managers or lifeguards available to keep it open. Mark Davis is saying that he should still get to the roof this year.

The land determined for the RHID will not be set until the land and easement agreement above is finalized and signed.

We have not provided Building Solutions with a NTP for the light pole at Main St and Elm. EMC insurance sent us a check for only about 40% of what it will cost to purchase and install a new one. Tyler has been trying to get hold of the insurance adjuster to find out why they haven’t gone after the trucking company. Tyler will also contact Southern Pioneer to find out their costs for their poles that were also damaged and replaced.

Zoning regulations for recreational vehicles, boats, campers, and trailers parking on the street for extended periods was reviewed again. The Council decided to table the issue until next Spring.

Advantage Computer now offers a customer utility portal, so customers can go online and look at their bills. The initial cost is around $1,000 and $360 every year after. The Council agreed that this is not needed at this time.

Minneola code is set at 20 firefighters. The County code allows for 25. Chad made a motion to approve Ordinance 2022-04 changing Minneola code to 25 to match the County, Marvin seconded, motion passed 3/0.

Fall Clean Up days have been set and the dumpsters will be located at the tree pit/recycle center area. They will be available only during regular open hours.

A resident inquired about installing an 8’ fence. The City does not have any codes against it. It was mentioned that we started working on fence codes in 2015, but it was never finished. The Council asked Brenda to work on an ordinance and present it at a future Council meeting.

Reminder that the September 19 Council meeting is very important. The City will hold the RNR hearing, pass the RNR Resolution, hold the Budget 2023 hearing, and pass the 2023 Budget. Brenda notified the Council that we received Clark County’s notifications about the different RNR hearings that will be held.

There will be a meeting at the Civic Connection on August 23, 2022, at 6:00 pm, for Lift, Housing Authority, and City. The groups will review what progress has happened to date and the future developments of Minneola.

Brenda let the Council know that she will be gone from September 8 through September 25 for surgery. We will wait and see how it goes after that. She contacted Carol Tedford, who is willing to come in part time and help with some of the paperwork while she’s gone.

The Council asked that the Clark County appraiser be called and see if they would be able to attend the Council meeting in October. The Council would like for them to review and explain why the appraisals increased substantially this last year.

Tyler reviewed a property that had water damage due to a City error. The Council gave Tyler the go ahead to resolve the issue.

The Council asked that the agenda be posted on our website if possible.

Marvin made a motion to approve the bills as presented, Chad seconded, motion passed 3/0.

Chad made a motion to recess the meeting until August 23, 6:00 pm, Marvin seconded, motion passed 3/0. Meeting recessed at 8:50 pm.
